Widerrufsbelehrung:
Nach Maßgabe der nachstehenden gesetzlichen Regelungen im BGB besteht ein Widerrufsrecht für Verbraucher und Verbraucherinnen nicht oder kann vorzeitig erlöschen. Die gesetzliche Regelung lautet auszugsweise wie folgt:
§ 312g Absatz 2 Nr. 9 Satz 2 BGB:
Das Widerrufsrecht besteht, soweit die Parteien nichts anderes vereinbart haben, nicht bei folgenden Verträgen:
9. Verträge [...] sowie zur Erbringung weiterer Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht.
Damit besteht für Verträge über den Kauf von Konzert- / Festival-Tickets kein Widerrufsrecht des Verbrauchers/der Verbraucherin und Ticketkäufers/Ticketkäuferin. Damit ist jeder Kauf der Tickets verbindlich.
Cancellation Policy
Right of Cancellation for Consumers
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.
Exclusion of the Right of Cancellation
No Right of Cancellation for Ticket Purchases
Pursuant to Section § 312g(2)(1)(9) of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for services related to leisure activities if the contract specifies a specific date or period for the provision of the service. This includes the purchase of tickets and admission tickets. Therefore, there is generally no right of withdrawal and/or return.
To comply with the withdrawal period, it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period expires.
For other items, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Contour Festival Organisations GmbH, Hemmelrather Weg 241, 51377 Leverkusen, email: merch@summerjam.de) by means of a clear statement (e.g., a letter sent by mail or an email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, though its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send notification of your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to Contour Music GmbH, Mülheimer Straße 126, 51469 Bergisch Gladbach immediately and, in any case, no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period expires. You are responsible for the direct costs of returning the goods. You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their condition, characteristics, and functionality.
